1. Purpose

These Terms of Use (“Terms”) define the terms and conditions governing access to, consultation of and use of the website karulink-caribbean.com, published by Société Transport Expansion Promotion (STEP) as part of the KARULINK project, co-funded by the European Union under the Interreg Caribbean 2021–2027 programme.

 

2. Acceptance of Terms

Access to and use of the website imply the user’s full, complete and unconditional acceptance of these Terms. Any user who does not accept these Terms is invited not to access the website or use its services.

 

3. Access to the Website

The website is freely accessible to any user with internet access. Any costs related to access to the website, including connection, equipment or software costs, remain the sole responsibility of the user. KARULINK reserves the right to modify, suspend, limit or interrupt access to all or part of the website at any time and without notice, in particular for maintenance, updates, technical developments or any reason relating to the proper functioning or security of the website.

 

4. Intellectual Property

All elements making up the website, including texts, images, illustrations, logos, videos, data, documents, graphic content, architecture, structure and technical elements, are protected by the applicable rules on intellectual property.

Unless prior, express and written authorisation has been obtained from KARULINK or STEP, any reproduction, representation, distribution, modification, adaptation, translation, extraction, reuse or exploitation, in whole or in part, of any element of the website, by any means whatsoever, is strictly prohibited. Trademarks, logos, corporate names, trade names, distinctive signs and, more generally, any protected element reproduced on the website remain the exclusive property of KARULINK, STEP or third parties who have authorised their use. The user undertakes to access and use the website in accordance with applicable laws and regulations, these Terms, public order and accepted standards of conduct. In this respect, the user is notably prohibited from:

KARULINK endeavours to ensure the accuracy, updating and availability of the information published on the website. However, such information is provided for information purposes only and does not guarantee its completeness, permanent accuracy or suitability for any particular situation. Accordingly, KARULINK, STEP or the project partners may not be held directly or indirectly liable in the event of:

      errors, omissions, inaccuracies or failure to update the information published;

      damage, loss or prejudice resulting from fraudulent, abusive, non-compliant or unlawful use of the website;

      temporary or prolonged unavailability of the website, including in the event of maintenance, updates, technical incidents, force majeure or any event beyond KARULINK’s reasonable control;

      consultation, use or content originating from third-party websites accessible from the website, over which KARULINK has no control as to content, practices or terms of use.

The website may contain hyperlinks to websites published by third parties, including partners of the KARULINK project such as ABCC, DAIC, SKNCIC, CARL or the City of Bouillante.

These links are provided for information purposes only. KARULINK has no control over the content, services, practices, privacy policies or terms of use of these third-party websites.

Accordingly, KARULINK may not be held liable for any content, information, products, services or practices accessible from such external websites, nor for any damage resulting from their consultation or use.

 

8. Personal Data Protection

Personal data that may be collected in connection with access to or use of the website is processed in accordance with the applicable regulations on personal data protection, including the General Data Protection Regulation (GDPR) and the French Data Protection Act. 9. Forms and Network Registration

Use of the forms available on the website, including contact forms or KARULINK network registration forms, implies acceptance of the website’s Privacy Policy. The data collected through these forms is used exclusively for purposes related to the KARULINK project, including the management of contact requests, network registrations, exchanges with users and, where applicable, the organisation of actions or events associated with the project.

KARULINK reserves the right to amend, supplement or update these Terms at any time, in particular to take account of changes to the website, the services offered, the KARULINK project or the applicable regulations. 11. Applicable Law and Jurisdiction

These Terms are governed by French law. In the event of a dispute relating to their interpretation, validity, performance or consequences, the parties shall endeavour to seek an amicable solution before initiating any legal proceedings. Failing amicable resolution, the dispute shall be submitted to the territorially competent French courts, in accordance with the applicable procedural rules.
